Rental Agreement Terms and Conditions

Hyperbaric Oxygen Therapy Christchurch LTD Rental Agreement

 

THIS RENTAL AGREEMENT is made between Hyperbaric Oxygen Therapy Christchurch Limited of 168 Hazeldean Road, Addington, 8025 Christchurch, New Zealand, hereinafter called The Owner and, the Renter.

 

By ticking the box when adding a product to your cart, you acknowledge that you agree to the terms and conditions outlined below. 

 

 

PROPERTY DESCRIPTION:

Hyperbaric Oxygen Therapy Christchurch warrants that to the best of our knowledge and belief the aforesaid property is free of deficiencies which could affect its safe and dependable operation under normal and prudent usage.

 

RENTAL PERIOD:

The Owner agrees to rent the Hyperbaric System to the Renter for the specified number of weeks agreed to upon purchase.

(unless an extension is authorised at a later date, in which case confirmation by email or letter will be supplied and become an extension of all terms and conditions of this agreement)

 

 

RENTAL RATE:

The Renter hereby agrees to pay the Owner for HBOT in advance for use of said property and any accessories/equipment for the full period, plus an additional delivery and install and $300 refundable cleaning bond*

*Please note that the cleaning bond is charged at a rate of $300 independent of length of hire time. To receive a full refund of this bond, the chamber is to be cleaned by the renter before pickup – including wiping down all internal parts with WARM WATER only (or our approved Cleaning Kits available to purchase through hyperbaric.co.nz), and vacuuming to remove any internal or external dirt.

The bond will be returned based upon the chamber being received in a clean and tidy manner. Please note the bond will be discounted at $100 per hour for time and materials that are required to clean the chamber on return. The FULL bond will be kept if there is any animal hair or staining present at time of pick up to cover additional dry cleaning fee and cleaning charges.

The renter agrees to pay the owner in advance.

 

Optional chargeable extras* include:

  • Delivery to and Collection from Rural Addresses or others that may incur an extraordinary cost for some reason. The extra charge will be discussed prior to commitment.
  • In person setup and training at your residence
  • Disassembly and repackaging at end of rental period

*Costs depend on location and access. Discuss with us.

 

 

USE AND CARE OF PROPERTY:

HOME USE ONLY

  1. Please note that unless otherwise arranged the Installer will set up and pack down the chamber themselves.
  1. All associated packaging materials must be retained in good order and reused at time of return
  1. The Renter further agrees that the rented property shall:
    1. not be used beyond reasonable normal capacity: under 60 hours of use for a 4 Week period for HBOT.
      1. The mHBOT system is expected to be used by The Renter once per day for a maximum two-hour session per day. In a 4 week period the total use should not exceed 60 hours. Any intention to use the system above this level should be discussed in advance with The Owner and only undertaken after receiving written approval to do so. A charge of $25 per hour for use over and above the benchmark will be charged.
    2. not be used in any manner for which it was not designed, built, or designated by the manufacturer in the operating manual
    3. not be used in a negligent manner
    4. not be used for commercial purposes

 

Hyperbaric Oxygen Therapy Christchurch is proud and delighted to provide you with this rental Hyperbaric System. Our intention is to supply rental equipment that is maintained at an exceptional standard and we depend on your cooperation towards this.  At completion of the rental term, we expect that we will receive the system back, complete and in as good a condition as when it was issued, subject to normal wear.

This System supplied will either be brand new or has been cleaned and checked out by our staff prior to shipment. If you believe that there is an issue with any of the system components, please call us immediately to discuss prior to commencing use of the system.

If, on return of the system, any of the parts of the system are found to be damaged, we reserve the right to charge you for repair or replacement of the component(s) as may be necessary.

 

INSURANCE:

The Renter hereby agrees that they shall fully indemnify the Owner for any, and all damage or loss of the rented property, including any accessories or related equipment, during the term of this Agreement whether caused by fire, theft, vandalism, or any other cause, except that which shall be determined to have been caused by a fault or deficiency of the rented property, accessories, or equipment.

 

Hyperbaric Oxygen Therapy Christchurch Ltd may not be held liable for any damage caused by the system to the Renters property or person.

 

We strongly suggest that you discuss with your Insurer to confirm that this equipment is covered by your Home & Contents Insurance policy. Equipment value for insurance purposes is $17,650 for HBOT.

 

RETURN OF PROPERTY TO OWNER:

The Renter will be responsible for packing down and repackaging the system and having it ready for the scheduled collection. Where necessary, the Renter hereby agrees to provide access for The Owner, or their agent, to collect the rental property and all accessories/equipment after the end date of the rental agreement. If the system is not available for collection on the day following the end of the rental period, a $150 per day penalty will be charged.

 

If all original packaging materials are not available for re-use by us or our agent at time of collection, the cost of procuring additional packaging will be charged to you in addition to $50 per day for any extra days required to rectify the situation.

 

TERMINATION OR EXTENSION OF AGREEMENT:

It is mutually agreed that the Renter shall have the right to terminate this Agreement at the completion of the rental period. It is also agreed that The Renter may request an extension of the Rental Period on a monthly basis at the agreed to Rental rate. Requests for extension of the agreement must be made no less than 30 days before the end of the agreement. The Owner reserves the right to extend or not.

 

CONTRA-INDICATIONS, CAUTIONS AND POTENTIAL SIDE EFFECTS:

The Renter confirms that they are aware of the contra-indications, cautions and potential side effects for Hyperbaric treatment.

 

The Renter further agrees that they will not allow use of the system by themselves or others in the event that the potential user:
For Hyperbaric Oxygen Therapy

  1. is currently taking any of, Cisplatinum, Disulphiram, or Doxorubicin
  2. is pregnant, has a Pacemaker or other implanted electrical device, or has a serious heart condition, unless those people have a written clearance from a relevant medical professional.
  3. has consumed alcohol within 3 hours prior to treatment
  4. has not read and confirmed to The Renter that they understand the information provided in Appendix 1 to this agreement titled “Mild Hyperbaric Oxygen Therapy Informed Consent”
